What is a lawful development certificate?

A lawful development certificate establishes the planning lawfulness of the use or work described in the application. It is a different test from deciding whether a proposal is acceptable on planning merits. It does not replace compliance with building regulations or other applicable requirements. [1]

A lawful development certificate concerns whether the development or use described is lawful in planning terms. For a proposed extension or garden room, its value lies in defining the actual proposal and recording a formal decision about that proposal.

The application depends on the facts and drawings supplied. The property type, earlier alterations and relevant restrictions need checking. A vague description or incomplete site information makes it harder to establish the correct position.

Keep the certificate and approved material with your property records. Check the technical design and any separate consents before construction. If you later change the scheme, do not assume the same certificate confirms the altered proposal.

Requirements depend on the property and the work proposed. For project-specific advice, the relevant drawings, site information and professional scope need to be considered together.
